Terms of Service

By downloading, installing, or using ASH ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

ASH is developed and published by Tomas Mihalicka ("Developer", "I", "me").

ASH is a secure, ephemeral messaging application that uses One-Time Pad (OTP) encryption for communication between two parties. The App is designed for high-security, low-frequency communication.

Key characteristics of the service:

• Messages are encrypted using One-Time Pad encryption
• Encryption keys are generated during an in-person ceremony
• There is no key recovery or key escrow mechanism
• Messages are ephemeral and cannot be recovered once deleted
• The service requires an in-person meeting to establish communication

By using ASH, you agree to:

• Use the App only for lawful purposes
• Not use the App to transmit illegal, harmful, or offensive content
• Take responsibility for safeguarding your device and encryption keys
• Understand that lost keys cannot be recovered
• Comply with all applicable laws and regulations in your jurisdiction

Important: ASH is designed with no key recovery mechanism. This is an intentional security feature, not a limitation.

• If you lose your device or delete the App, your encryption keys are permanently lost
• The Developer cannot recover, reset, or regenerate your keys
• There is no "forgot password" or account recovery option
• You are solely responsible for maintaining access to your device

ASH is designed with privacy as a core principle. Please review our Privacy Policy for detailed information about data handling.

Key points:

• Messages are end-to-end encrypted with One-Time Pad encryption
• The relay server cannot decrypt your messages
• No user accounts or identifiers are required
• Minimal metadata is processed, and only transiently

The App and its original content, features, and functionality are owned by Tomas Mihalicka and are protected by international copyright, trademark, and other intellectual property laws.

The cryptographic core of ASH is open source and available under the terms specified in the project repository.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Developer does not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or other harmful components
• The security provided will meet your specific requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

This includes, but is not limited to:

• Loss of encrypted messages due to key loss
• Inability to communicate due to pad exhaustion
• Any consequences arising from the security model of the App

You may not use ASH:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, or state regulations, rules, or laws
• To infringe upon or violate the rights of others
• To transmit malware, viruses, or any code of a destructive nature
• To harass, abuse, insult, harm, or discriminate against others

You may terminate your use of ASH at any time by deleting the App from your device. Upon deletion, all local data including encryption keys will be permanently destroyed.

The Developer reserves the right to terminate or suspend access to the relay service at any time, without prior notice, for conduct that violates these Terms or is harmful to other users or the service.

The Developer reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the App after changes constitutes acceptance of the modified Terms.

It is your responsibility to review these Terms periodically for changes.

These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions.
